Official Contest Rules

NO PURCHASE NECESSARY. VOID IN QUEBEC AND WHERE PROHIBITED BY LAW. MANY WILL ENTER, FEW WILL WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING THE STANDARD PRIZE.
THESE RULES GOVERN ALL ASPECTS OF PARTICIPATION AND PRIZE AWARD, INCLUDING THE GRAND PRIZE.

Introduction. The Ashley Madison™ Summer Splash at the Playboy Mansion Contest is sponsored by Avid Dating Life Inc. as operators of the Ashley Madison Agency™ business (“Ashley Madison”), Suite 1906, 2300 Yonge Street, Box 2305, Toronto, Ontario, M4P 1E4. The Standard Prize Drawing and Grand Prize Drawing are sponsored by Ashley Madison (the “Sponsor”).
The Standard Prize Drawing and the Grand Prize Drawing are referred to collectively as the “Promotion.” The Promotion is subject to all applicable federal, state, provincial, municipal, territorial and local laws and regulations.
UP TO A MAXIMUM OF FIFTEEN (15) PRIZES WILL BE OFFERED IN THE STANDARD PRIZE DRAWING AND ONLY ONE (1) PRIZE WILL BE OFFERED IN THE GRAND PRIZE DRAWING.
Timing. The Promotion begins 12:00 a.m. Eastern Time ("ET") on June 24, 2008 and ends 11:59 p.m. ET on July 23, 2008 (the "Promotion Period").
Eligibility. The Promotion is open to legal residents of the fifty (50) United States (including the District of Columbia) and Canada (excluding Quebec), twenty (21) years old and older at the time of entry. By participating and/or receipt of any prize, entrant agrees to abide by these Official Rules and the decisions of Sponsor, which are final and binding in all respects. Void in Quebec and where prohibited by law.
How to Enter. The contest consists of a series of random draws: (a) a Standard Prize Drawing, and (b) the Grand Prize Drawing. To enter the Standard Draw, you must sign-up as a Guest Member on the Ashley Madison website at www.AshleyMadison.com/Bunny. To enter the Grand Prize Draw, you must sign-up as a Full Member on the Ashley Madison website by purchasing one of the three Full Member Packages (Standard, Premium or Ultimate) using an applicable credit card or you may mail a letter to “Playboy Contest” c/o Ashley Madison, 2300 Yonge Street, Suite 1906, Toronto, Ontario, M4P 1E4 with your User Name and Profile Number and you will automatically be entered into the Grand Prize Drawing. Each Membership Package purchased will automatically make you eligible to receive a ballot for the Grand Prize (Standard = 1 ballot, Premium = 5 ballots, Ultimate = 10 ballots). All potential winners are subject to verification before any prize will be awarded. Limit: Each participant for the Standard Prize Draw may only enter one (1) time per day during the Promotion Period. Any attempt by any person to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that person’s entries and that he/she may be disqualified. In the event of a dispute as to the identity of an entrant, the authorized account holder of the email address used to enter will be deemed to be the entrant. Potential winners may be required to show proof of being the authorized account holder. The "authorized account holder" is the natural person assigned to an email address by an Internet service provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address.
ALL POTENTIAL WINNING ENTRIES ARE SUBJECT TO VERIFICATION BY THE SPONSOR, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE PROMOTION. AN ENTRANT IS NOT A WINNER OF ANY PRIZE, EVEN IF THE PROMOTION SO INDICATES, UNLESS AND UNTIL ENTRANT’S ELIGIBILITY AND THE POTENTIAL WINNING ENTRY HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. SPONSOR WILL NOT ACCEPT SCREEN SHOTS OR OTHER EVIDENCE OF WINNING IN LIEU OF THEIR VALIDATION PROCESS. ANY ENTRY THAT OCCURS AFTER THE SYSTEM HAS FAILED FOR ANY REASON IS DEEMED A DEFECTIVE ENTRY AND IS VOID AND WILL NOT BE HONORED.
Winner Selection.
1. Standard Prize Drawing: Standard Draws will be held every second day from eligible entries received from the commencement of the Promotion Period to the day immediately preceding the applicable Standard Draw. Entries must be received by 11:59:59 PM Eastern Time on each of the Standard Draw dates (i.e. June 26, 28, 30, 2008 and July 2, 4, 6, 8, 10, 12, 14, 16, 18, 20, 22 and 24, 2008) to be eligible for the Standard Draw. Automated Standard Draws will be held in Toronto, Ontario approximately 10 minutes after each Standard entry window has closed, beginning at approximately 12:10 AM Eastern Time on June 26, 2008 until 12:10 AM ET on July 24, 2008.
2. Grand Prize Drawing: The Grand Prize Draw will be held on or about July 24, 2008, at approximately 10:00 AM Eastern Time in Toronto, Ontario from all eligible entries received during the Promotion Period.
Requirements of Potential Prize Winners. Potential winners will be notified by email. Except where prohibited, each potential Grand Prize and Standard Prize winners will be required to correctly answer a mathematical skill-testing question, without assistance of any kind, whether mechanical or otherwise, to be administered by email, or telephone and execute and return to Ashley Madison, within two (2) days of being notified, an Affidavit of Eligibility, Liability & Publicity Release (“Affidavit”) (if U.S. resident) or a Declaration of Compliance (“Declaration”) (if Canadian resident) to claim his/her prize. If a potential winner cannot be contacted, or fails to sign and return the Affidavit or Declaration within the required time period (if applicable), he/she forfeits the prize. In the event a potential Grand Prize or Standard Prize winner is disqualified for any reason, Ashley Madison will award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries.
Prizes.
1. Grand Prize: ONE (1) GRAND PRIZE: The Grand Prize consists of a Playboy fantasy weekend comprising of: two (2) passes to the Summer Splash party at the Playboy Mansion to be held on August 1, 2008, round-trip airfares for winner and guest (to a maximum of $1,000 per ticket), two (2) nights accommodation at a four-star hotel in Beverly Hills (standard hotel room) (to a maximum of $1,500 in total for both nights), California, and a total of five hundred dollars ($500) spending money. Approximate Retail Value (“ARV”): $5,000.00 USD. Winner is responsible for obtaining all necessary and required travel documents, including documents for international travel between U.S. and Canada (if applicable). Lodging, meals, gratuities, additional ground transfers, transportation, insurance, incidentals, airport taxes and any other expenses are the sole responsibility of the winner. Sponsor will not replace any lost or stolen tickets. Once booked, no change, extension, or substitution of travel dates permitted, except by Sponsor in their sole discretion. The odds of winning a prize depend upon the number of eligible entries received by each entry deadline for each series of random draws (deadlines described above).
2. Standard Prizes: UP TO FIFTEEN (15) STANDARD PRIZES: two (2) passes to the Summer Splash party at the Playboy Mansion to be held on August 1, 2008. ARV: $1,000 USD.
For all prizes: Winners are responsible for all federal, state, provincial and local taxes and other fees associated with prize receipt and use. No substitution, assignment or transfer of prizes permitted, except by Sponsor, who reserves the right to substitute a prize with another prize of greater or equal value if prize cannot be awarded as stated. Total ARV of all prizes: $20,000 USD.
Publicity. Except where prohibited, participation in the Promotion constitutes winner's consent to Sponsor’s use of winner's name, likeness, voice, opinions, hometown, state/province and country for promotional purposes in any media without further payment or consideration.
General Conditions. Sponsor reserves the right to cancel or modify the Promotion if fraud, technical failures or any other factor beyond its reasonable control impairs the integrity of the Promotion, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award the prize at random from among the eligible entries received up to the time of the impairment. Sponsor reserve the right, in its sole discretion, to disqualify any individual they find to be tampering with the entry process or the operation of this or any other promotion or to be acting in violation of these Official Rules or any other promotion, or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately damage Sponsor’s Web site or undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
Release. By receipt of any prize, winner agrees to release and hold harmless Sponsor and its respective related companies and each of their respective officers, directors, employees and agents from and against any claim or cause of action arising out of participation in the Promotion or receipt or use or misuse of any prize.
Limitations of Liability. By participating in this Promotion, entrant hereby releases Sponsor and its respective related companies and each of their respective officers, directors, employees and agents from any claims arising from: (1) incorrect or inaccurate transcription of entry information or late, lost, stolen, illegible, incomplete, misdirected, or entries received through impermissible or illegitimate channels, all of which will be disqualified; (2) technical failures of any kind, including but not limited to the malfunctioning of any telephone, computer, network, hardware or software; (3) the unavailability or inaccessibility of any service; (4) unauthorized human intervention in any part of the entry process or the Promotion; (5) electronic or human error which may occur in the administration of the Promotion or the processing of entries; or (6) any injury or damage to persons or property, including but not limited to entrant’s computer, which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Promotion or from downloading any material from Sponsor’s Web site(s), regardless of whether the material was prepared by any Sponsor or a third party, and regardless of whether the material is connected to a Sponsor’s Web site by a hypertext link. If, for any reason, an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Grand Prize Drawing or another Standard Prize Drawing, provided that if it is not possible to award another entry due to discontinuance of the Promotion, or any part of it, for any reason, Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In the event that for any reason more than the stated number of prizes as set forth in these Official Rules are available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.
Disputes. Entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Promotion or any prizes awarded shall be resolved individually, without resort to any form of class action, and exclusively by the Ontario Court General Division located in Toronto, Canada; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant, Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the Province of Ontario without giving effect to any choice of law or conflict of law rules (whether of the Province of Ontario or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Province of Ontario, Canada.
Data Collection. Sponsor collects personal information from you when you enter the Promotion. The information collected is subject to the Ashley Madison privacy policy as referenced on the Ashley Madison website at www.AshleyMadison.com.
